How easily do Social Security Widow and Disability benefits transfer from one state to another? This year I am moving to a new state and I would like my mother to move there too. If marriage is a sacred union, doesn't that mean that social security shouldn't give widow's benefits? Married people get a lot of stuff that other people don't get, like the ability to get a 10% discount on car insurance for starters and the ability to get a discount on health insurance when going through one of their work policies. And of course there's widow's benefits, the ability to visit each other in the Intensive Care Unit. I say that if marriage is the thing that is sanctioned by the bible, then the government should step out of the process and not even require licenses. Separation of church and state. The U.S. is a Democracy, not a theocracy like the Taliban. That means our government isn't supposed to make women wear burkhas or give special favors to religious institutions. Limiting "marriage" to the narrow terms defined by your religion makes sense in a theocracy. If you insist on defining "marriage" as sacred, it's not a valid part of our democracy. Why would you take your mom's benefits away just to keep the "atheists and other undesirables" as someone said, from calling their unions "marriage?" Explain that to her, would you? Civil unions don't have the same privileges as marriages. That's the point, silly. Civil union laws vary from state to state, too. In some states, civil unions don't have the right to visit their partner in the hospital or get health insurance through their company. Companies (DRS Technologies is one that I'm aware of) are allowed to refuse to insure partners in a civil union. They also get to pick whether to insure spouses in specific states if they don't like the marriage laws in that state.

Living in Texas,recently widowed,(my husband died on Sept 29th),of this year. we were both receivibg social security benefits. I was getting $173.00 of my own. Plus $373.00,(based on my husbands benefits of $973.00 that was his own benefits). Since his death I have been to the social security office in my area and spoken to a rep. there. What do you think about the Social Security Widow's 7 year rule? I just discovered Social Security has a rule which says a disabled widow must be over 50 to apply for benefits under her husbands work record. Also her disability must have occurred within 7 years of his death. HR 770 has been "on hold" in the Ways and Means Committee for over a year and a half and if PASSED would change the Rule, but so far nothing is being done and the 7 year rule stands as is. §404.335 What is Disabled Widow’s Benefits? This is a disability program where the claimant can apply for benefits based on the deceased spouse’s earnings record. You must be 50 years or older and the onset of your disability must be within 7 years of your spouse’s death. Does anyone else think the 7 year rule is outrageous? Andy - it has nothing to do with how long your husband worked. He could have worked and paid into social security his whole life and it wouldn't mean a thing because of the 7 year rule. What the rule says is YOU (the widow) MUST BECOME DISABLED WITHIN 7 YEARS OF YOUR HUSBAND'S DEATH. If you become disabled 7 years and 1 day after your husband's death you don't get the benefits. The day I went before the judge for my social security disability, I was awarded it, plus as my husband died 3 months before, I was awarded widow's benefits at same time. I was 57 at the time and my husband died at age 63. I get 2 checks of which one is under my SS# for $627 and another check from my husbands's (I guess this is my widow's benifits) for $285. My husband made much more than I ever made. It seems that I should be getting more from my husbands for my widow's benefits. I've called several times and always get the run around--usually hung up on as they transfer me to someone else. I also received disability from my work, which I was sent a lump sum, but had to return all but 400 of it back as they said they had overpaid me for the years I received it. This was from where I had worked. I sent them the check back. I really don't understand why my check would be higher than my widow's check. Does this seem right? How does a retired widow get her hands on all the money she has coming to her? My mother is 66 this years. Has previously been on disability but this has ended.She became a widow 6 years ago. Her total income, per month is now $752. She cannot survive on that kind of money when her RX's are $700.She is applying for Medicare help but that is still not enough to live on. Who or where should she turn to see if she qualifies for any governmental help? She does not receive my deceased fathers social security and has no savings. Why is the surviving mother not eligible to receive the $255 dollar amount that Social Security says they pay? The person I am referring to was a 50 year old male on social security disability. He recently passed of pancreatic cancer. His mother is 83 years old and on a fixed income. She had to put up the expenses to pay for his cremation. Just because he has no minor children nor married at the time of his death, his mother should not be penalized and would benefit from the $255 dollar amount. She could really benefit from even that small amount to help in her costs. Is there an avenue to appeal this decision?

Do you know the difference between SSI and SSDI? I have found that many people on here are confused about which programs benefits they are receiving. SSI stands for Supplemental Security Income. It is a welfare program and it pays benefits to the blind, disabled or aged individual only. Entitlement to SSI automatically enrolls a person into Medicaid which is handled by the county welfare office. It is NOT a Social Security benefit although it is administered by the Social Security program. Benefits are paid from general taxes. SSDI stands for Social Security disability income. It is not a welfare program. It pays benefits to people who have worked and paid Social Security taxes long enough to be entitled to monthly benefits. If someone is entitled to SSDI and they have minor children those children can also receive monthly benefits. Spouses and widows/ers are paid under the Social Security program. After 24 months of entitlement to SSDI a person is eligible for Medicare. Social Security also pays retirement and survivor benefits. If someones Social Security benefit is low enough (under $694) they might also be eligible for SSI benefits. However, the SSI benefit will be reduced by all but $20 of the Social Security benefit. For example, if the Social Security benefit is $500 the SSI benefit would be reduced by $480. If you want good answers to your questions it is helpful that you know which benefit you are receiving so that you can get correct answers. Why do people not equate paying into health care insurance the same as paying into social security insurance? I know many cases where people pay their health care premiums but then someone in their family gets in an accident, ends up with cancer, needs surgery, or something else. They end up pulling Way more insurance money then they ever put in. People seem ok with this. If you pay into social security for many years and get disabled, people have a problem with people receiving the benefit. Isn't the fact they paid into it, with the assumption their contributions would pay for disabled people, enough. Any of us could fall down. That's what we have insurance for.
